The Karnataka High Court has stayed an FIR filed against four advocates for allegedly threatening a Chikmagalur police officer and obstructing duty in the wake of protests against an attack on another advocate.
A single-judge bench of Justice Hemant Chandangoudar issued the order after the advocates approached the court seeking stay on the FIR filed on December 3.
The high court had taken suo motu cognisance of an alleged attack on one of the advocates by policemen after a dispute over riding two-wheeler without helmet in Chikmagalur on November 30 and registered a case against six policemen. These policemen were suspended on December 1, and a deputy superintendent-rank police officer began an investigation.
In the FIR filed against the four advocates, a police officer alleged that when he had gone to take the statement of the attacked advocate, his phone was snatched and he was prevented from carrying out his duties by the group of lawyers.
Senior advocate Vivek Subba Reddy, appearing on behalf of the petitioners, argued that no specific allegations were made against any of the four advocates apart from general and omnibus allegations. He questioned the reasoning behind lodging the FIR on December 3 when the original incident had happened three days earlier.
The court stayed the FIR until the next hearing.
